Exploiting a software bug in a poker machine does not constitute hacking[23] because the poker machine in question was not a “protected computer” under the statute (not being connected to the Internet it was judged not to qualify as “protected computer” affecting interstate commerce) and because the sequence of button presses that triggered the bug were considered “not exceed their authorized access.” As of November 2013 the defendant still faces a regular wire fraud charge.[24]
